The contract clause that led to Evander Kane's downfall, as explained by Insider

The last 24 hours have been a whirlwind for Evander Kane. His contract would have saw him earn over $20 million over the course of the next four years. He is now facing the very real prospect of getting nothing after having his deal terminated by the San Jose Sharks for an apparent breach of protocol. As for how exactly this works, Sportnet's Elliotte Friedman had the explanation.

"There's a section, it's 14A," said Friedman, describing the standard NHL player contract. "Failure, refusal or neglect to render services and/or other material breach of the contract. Failure to conduct yourself on and off the rink according to the highest standards of honesty, morality, fair play, and sportsmanship. And, to refrain from conduct detrimental to the best interest of the club of the club...and a material breach while on loan to the American Hockey League."

Kane was, of course, a member of the AHL's San Jose Barracuda when his contract with the San Jose Sharks was terminated. He was sent there after serving a 21 game suspension for using a fake vaccination card. I am not a lawyer, but it seems to me that should have been grounds to terminate his contract if considering the clause included above. However, for whatever reason, that didn't happen.

Kane's camp and the NHL Player's Association have vowed to fight the contract termination stating the Sharks did not have grounds to do so. The NHL has stated it is satisfied the Sharks were within the conditions set out in the contract. A report states Kane travelled to Vancouver knowing he was COVID positive and while he was supposed to be in quarantine. . As Friedman mentions, none of this has been proven and it's not known if an arbitrator will find that to be sufficient grounds to terminate his contract. That said, it appears we'll find out soon enough as the NHLPA's grievance over the issue has been filed.
